I go to court next Tues the 1st in Maricopa county, Arizona on a charge of civil contempt for failing to pay court ordered child support. Since they are using civil contempt I am not entitled to have an attorney appointed for me. The reasoning is that in civil contempt the contemnor always has "the keys to his cell in his pocket". The policy in this court is to incarcerate in the county jail with eligibility for a work furlough program. I contend that such a result is unlawful if I am willing to comply and trying to comply. Civil contempt is supposed to be coercive in nature and there is no justification for incarceration once I have indicated my willingness to comply. Similarly, neither the purge amount nor the child support order can be beyond my means to pay or once again choice is taken from me and I have no way to comply even though I desire to do so. Any help out there before my wife and 3 kids, including one newborn, end up on welfare trying to get me out of jail??
