I need to know what laws govern negligent landlords and how tenants are protected (are we able to go to court and void the lease?). What are the specific requisits for a judge to grant permission for tenants to be released from a lease?
My landlord has breeched his lease agreement as regards: a fully-functioning house to move into (stove not working, air conditioning not working: in August in Arkansas!) late fees (supposed to come out of deposit, but, he required a late fee be paid with the late rent...we originally withheld rent until repairs were made but then sent it with the late fee upon consulting an attourney... we have since been consistent with our payments), and failed to make repairs since we moved in during a reasonable amount of time on significant functions of the house: commode broken for over a week, door to the outside not lockable for several weeks. He lives in another state and repair people arrive weeks later or not at all after a phone call to him requesting a repair).
We have been advised of one option: give him 30 days notice and wait to see if he takes us to court. I want to make a claim against him, first, as I think we have a case of negligence. What do you suggest?
